duly authorized for the purposes hereof.

Hereinafter the “Seller” or “the SCIC”

Hereinafter, “the Buyer”, or “the Customer”
On the other hand,
It was explained and agreed as follows:

PREAMBLE
The Seller creates and markets carpets resulting from the transformation of wool, intended for the Customer.
These General Terms and Conditions of Sale apply to all carpets sold via the website www.lesateliers.laines-paysannes.fr or by remote control (mail, telephone, etc.).

For his part, the Customer undertakes to be able to conclude a sales contract under French law. The information provided by the customer and recorded by Laines Paysannes when the contract is concluded will have the force of proof.
The Seller reserves the right to modify them at any time. The version in force for a sale in progress will be the one in effect on the date of the conclusion of the sale.

Article 1: object
These General Conditions of Sale govern the rights and obligations of the parties, generated by the sale, online or remotely, of SCIC Laines Paysannes rugs. The Seller markets carpets resulting from the transformation of wool. Sales are concluded directly with the Customer following confirmation of an estimate sent by email.

Article 2: Rates
The prices of the products sold are indicated in Euros All Taxes Included on the presentation page of the mats.

SCIC Laines Paysannes reserves the right to modify the prices at any time, but the price charged will be that mentioned at the time of the conclusion of the sales contract and subject to product availability. If necessary, it will be the one mentioned on the estimate, the period of validity of the latter being one month from its issue.

The product remains the property of SCIC Laines Paysannes until full payment of the price by the Customer. Once the Customer is in physical possession of the product, he is responsible for any damage or loss.

Article 3: Conclusion of the distance selling contract
The conclusion of the sales contract between the Customer and the Buyer will be concluded according to the steps and methods described in this article.
The Customer can place an order  :
By telephone, at the following number: 05.61.60.96.48. The price of the telephone conversation will be that applied by his operator for a conversation to metropolitan France, from his place of residence.

The customer will be able to consult the information on the characteristics of the product(s), then make the choice of the product(s); he must read the information made available to him on the terms of payment and delivery and fill in the information that will be requested of him. Finally, to validate his order, he must imperatively read and accept the T&Cs.
The Customer will receive by email the confirmation of his order, as well as a link to these General Conditions of Sale. He will then receive an email informing him of the preparation and then the dispatch of his order.
The validation of the steps described above and/or the “double click of validation” (law of March 13, 2000 on the electronic signature) will be worth proof of the transaction.
SCIC Laines Paysannes reserves the right not to register a payment or not to confirm an order, for any reason whatsoever, for example in the event of difficulty in supplying a product or following the observation of a difficulty concerning the order received. In this case, he will inform the Customer by email.
The delivery of the products will be made to the address indicated by the Customer. In accordance with article 1316-1 of the Civil Code, the Customer undertakes to provide his true identification elements.

Article 4: Product information
The essential characteristics of the goods and their respective prices are made available to the Buyer on the SCIC website. The Customer certifies having received a detail of the delivery costs as well as the terms of payment, delivery and execution of the contract. Any order by the Customer constitutes acceptance of the prices and description of the products available for sale.
The Seller undertakes to honor the Customer’s order within the limits of the stocks of available products only. Otherwise, the Seller informs the Customer. This contractual information is presented in detail and in French. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The period of validity of the offer of the Products as well as their prices is specified on the website of the SCIC or on the estimate proposed by it.

Article 5: Terms of delivery
Shipping cost
Shipping and delivery costs are mentioned on the order summary. They are the responsibility of the Customer.
The Customer located in a country other than metropolitan France is considered to be an importer of the products concerned by the order. In this case, customs duties, import duties or State taxes may be payable. They are therefore the responsibility of the Customer and are not considered to be the responsibility of the Seller. As such, the Seller invites the Customer to find out about any costs that may be claimed from him with the competent local authorities.
Address and deadlines
The products are delivered to the delivery address which was indicated when ordering.
The production time for a rug is about two months. The client is informed in good time of the progress of the design. At the end of the realization and from the reception of the payment, the maximum delay for the expedition of the order is maximum 7 working days. To this period is added that of the carrier responsible for the delivery.

Expeditions
When each order is dispatched, the Customer will be informed by email.
Laines Paysannes subcontracts its deliveries with La Poste.
When the delivery requires making an appointment with the Customer, this can only be done according to the possibilities offered by the subcontractor. When the Customer orders several products at the same time, these may have different delivery times routed according to the following terms  : the customer will be informed of the shipment of each item by email.

In the event of a delay in dispatch due to the Seller, the customer will be informed by email and may exercise a right of withdrawal.
In the event of late delivery, the Customer has the possibility of terminating the contract under the terms and conditions defined in Article L 138-2 of the Consumer Code. The Seller then reimburses the product and the “one-way” costs under the conditions of Article L 138-3 of the Consumer Code. The Seller provides a telephone contact point indicated in the order confirmation email in order to follow up on the order. It is the Customer’s responsibility to notify the carrier of any reservations about the delivered product.
Delivery tracking
If the customer chooses the shipping tracking option for his order, he will have access to the tracking of his package using the tools put in place by La Poste.

Article 6: Payment
The payment of the price of the order by the Customer generates validation of the sales contract. Payment is due immediately upon order. The Customer can make payment by credit card, bank transfer or bank cheque. Secure online payment by credit card is made by our payment provider Express Paypal Checkout. The responsibility for any defects during the payment stage therefore lies with him.
Once the payment has been validated by the Customer, the transaction is immediately debited. By communicating his banking information during the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the Sale is immediately resolved as of right and the order cancelled.

Article 7: Withdrawal period
In accordance with Article L. 121-20 of the Consumer Code, the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception, if applicable, return costs. The period mentioned in this article runs from the receipt of the product by the Customer. The right of withdrawal can be exercised by contacting the Seller by email. We inform Customers that in accordance with Article L. 121-20-2 of the Consumer Code, this right of withdrawal cannot be exercised for the following reasons  :
goods subject to a characterized personalization. In this case, any embroidery or specific marking of the product, carried out at the request of the Customer.
goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

In the event of exercise of the right of withdrawal, Laines Paysannes will refund the order within 14 clear days of receipt of the product returned by the Customer. The refund will be made by the same means of payment as that used by the Customer.
Product returns must be made in their original packaging. Laines Paysannes will only refund them after checking that the product is in good condition. The Customer will find in these T&Cs the withdrawal form to be returned to Laines Paysannes.

Article 8: Availability and presentation
Orders will be validated and processed within the limits of our available stocks. In the event of unavailability of raw materials, the Customer will be immediately notified of the foreseeable delivery times and the order for this article may be canceled on simple request. The Customer may then request a full refund of the price of the item, or a credit note.

Article 9: Complaints
The Customer may submit any complaint by contacting the Seller using the following contact details  :

In the event of a request for exchange or refund of a product, the return costs are entirely the responsibility of the Customer and will not be reimbursed by Laines Paysannes, except in the case of a non-compliant product (see Article 10).

Article 10: Warranties
In accordance with legal provisions, the Seller is bound by the following guarantees  :
– guarantee on the hidden defects of the product
– conformity of the product in relation to the essential characteristics mentioned during the sale.
If a finding of default relating to one of these two obligations is made by the Customer, the Seller proceeds to the exchange or refund of the amount of the product concerned according to the means of payment chosen by the customer.
In this context, any request for exchange or refund must be made within 30 days of receipt of the order by the customer, by  :

The burden of proof rests with the Seller. The Customer can also assert the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code. The Seller reminds that the Customer can choose between the replacement of the goods subject to possibility or its reimbursement.

Article 11: Nullity and modification of the contract
If one of the stipulations of this contract were cancelled, this nullity would not entail the nullity of the other stipulations which will remain in force between the parties. Any contractual modification is valid only after a written and signed agreement of the parties. The Seller reserves the right to cancel the contract in the event of force majeure.

Article 12: Protection of personal data
In accordance with the Data Protection Act of January 6, 1978, the Customer has the rights to query, access, modify, oppose and rectify his personal data via his customer account. By adhering to these general conditions of sale, he consents to Laines Paysannes collecting and using this data for the performance of this contract. The Seller undertakes not to disclose this data or resell it to any partner network.
If necessary, the customer wishing to receive the Newsletter will see his personal data integrated into a database allowing its distribution.
Laines Paysannes makes every effort to contribute to the protection of the personal data of its customers. Thus, they are only kept for the time necessary to carry out the order and then archived in such a way as to be accessible on request by the customer. At any time, the latter may request to have access to them or to have them deleted.

Article 13 – Liability
The products offered comply with the French legislation in force. Laines Paysannes cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is up to the Customer to find out from the local authorities about the possibilities of importing or using the products ordered.
Furthermore, Laines Paysannes cannot be held liable for damage resulting from improper use of the purchased product.

Article 14 – Archiving Proof
The Seller will archive the purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized registers of SCIC Laines Paysannes will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.

Article 15: Applicable law
All the clauses appearing in these general conditions of sale, as well as all the purchase and sale operations referred to therein, will be subject to French law. In the event of a dispute, the customer may seize the competent Commercial or Instance Court.
